PARENTS UNITED OF POTOMAC MD CALLS ON FEDERAL PROSECUTOR TO INVESTIGATE STATE-SPONSORED KIDNAPPING, $1.2M THEFT, AND CIVIL RIGHTS ABUSES IN WEST VIRGINIA COURT

— The civil rights and child advocacy nonprofit, United Families of Potomac MD, is issuing an urgent public call to action. We are demanding that the United States Attorney for the Northern District of West Virginia launch an immediate federal corruption and civil rights investigation into a multi-agency conspiracy operating out of the 27th Judicial Circuit in Berkeley County, West Virginia.

For over 1,150 days, a 9-year-old child has been held hostage across state lines in a documented case of state-sponsored kidnapping. Local officials—including a judge, a prosecutor, and the West Virginia Department of Human Services (WVDOHS)—have operated as a rogue entity, actively defying federal law, suppressing exculpatory medical evidence, and facilitating the theft of $1.2 million in marital assets from a paralyzed minority father.

“This is not a family court dispute; it is a criminal enterprise operating under the color of law,” said a spokesperson for Parents United of Potomac MD. “A Maryland judge and Maryland CPS and Maryland hospital fully exonerated this disabled father, finding absolutely no signs of abuse. Instead of respecting federal jurisdiction, West Virginia authorities forged records, buried evidence, and used a disabled man’s stroke against him to steal his child and his life savings.”

The Core Wrongdoing & Systemic Abuse: Our organization has compiled a comprehensive 12-part dossier of primary source evidence proving severe constitutional and federal violations, including:

• Jurisdictional Kidnapping & Forgery: On April 19, 2024, the mother executed a premeditated felony abduction, signing the child out of school and fleeing to West Virginia. She only began disseminating these accusations of abuse when she was facing a felony for this kidnapping. Just days prior, she had attempted to force a medical diagnosis to frame the father, but the scheme spectacularly backfired: the child initially denied the abuse to a doctor despite her mother’s coaching, and the medical exam definitively found “no signs of abuse.” Despite Maryland ruling the claims “Not Substantiated,” WVDOHS officially found the child “SAFE” in July 2024, but deliberately hid this report in a separate file and forged a “phantom referral” to justify seizing the child and blocking Maryland’s Exclusive Continuing Jurisdiction.The prosecutor that blocked kidnapping And sexual abuse investigation and the one that always protects county employees Catherine Delligatti so in a blatant conflict of interest she is now Grading her own homework and and gross misconduct and concealing it.
• ADA Title II Violations & Medical Coercion: The presiding judge, Catherine Delligatti, defied a treating physician’s e-filed mandate limiting court hearings to four hours for the paralyzed stroke survivor. The court forced an 8-hour hearing, using bailiffs to prevent the father from leaving, which triggered a medical collapse (TIA) in the parking lot. The judge then closed the evidentiary record and ruled against the father while he was medically incapacitated. The judge literally found him guilty for having a second stroke that she caused by trapping him in the courtroom and disregarding his well being and doctor’s orders.
• The 300-Day Cover-Up: To block the father’s appellate and federal civil rights relief, the 27th Judicial Circuit withheld the official court transcripts of this medical coercion for over 300 days.
• State-Sanctioned Sexual Exploitation: The mother had six referrals for sexual and psychological abuse, neglect and coaching from two different state courts and from law enforcement. Her friends that work for child welfare did not even spend a minute investigating the allegations or the child’s life threatening weight loss. The judge like she does for all county employees gave her full amnesty. Putting the reputation of the county over the safety of the children. She blocked the mandatory court ordered reunification therapy and visitation from the father which is a violation of the Constitution and instead with no evidence whatsoever Has denied him any access to his child and no due process. These hearings are supposed to be 30 days We’re going on 800 and the mother had kidnapped the child exactly a year before and it and he had one week after fighting a year to get custody only for her to flee to West Virginia. This woman is a disturbed individual who has refused to get help for her mental disorders for years and was involved in the death of a 5 year old child in Hagerstown which is why she was forced to leave the state and get employment in Berkeley County. She was protecting another abusive mother who was her friend Instead of doing the right thing and reporting the abuse like she’s supposed to. The same thing Catherine Delligatti is doing.

Meanwhile the the mother who works for the school system had six referrals for sexual abuse psychological abuse and neglect as well as coaching and was never investigated and confessed to the sexual act

the last day of testimony only for Judge Delligatti to give her amnesty from that and her and kidnapping the child across state lines on April 19th 2023 and again on April 19th 2024. She had her daughter taken away when she abandoned her at a stranger’s house during a mental episode.

• Financial Liquidation: By utilizing systemic delays and denying stays, state actors facilitated the theft of $1,250,000 in marital assets and the diversion of $50,000 in Social Security disability benefits.
• This father does not even live in West VA and the only time he is in West Virginia is to drop up drop off and pick up his daughter 15 minutes over the border. West Virginia has literally stolen this child from Maryland in a matter that they have already ruled him innocent on. It is a federal violation to conduct a second child welfare investigation and to relitigate and they are doing it for a third time illegally without any jurisdiction or evidence. Just the word of a confessed kidnapper and abuser that was caught and sanctioned in Maryland for over 30 false allegations and 80 false statements.

Delligatti, is the same prosecutor that refused to prosecute teachers who were caught on video physically assaulting and hitting a special special needs child And whose husband is legal director for the county Protecting the county from liability.

CALL TO ACTION: West Virginia’s 27th Judicial Circuit is operating as a “Star Chamber,” defying the Supremacy Clause, the Americans with Disabilities Act (ADA), and the Violence Against Women Act (VAWA) with absolute impunity.

Parents United of Potomac MD is urging all concerned citizens, advocates, and members of the press to call the U.S. Attorney’s Office for the Northern District of West Virginia and demand a federal investigation under 18 U.S.C. §§ 241 and 242 (Deprivation of Rights Under Color of Law).

The public cannot allow a local court to unilaterally nullify federal law, torture a disabled American, and participate in the kidnapping of a child.
